En consecuencia, se dirime la controversia con la remisión del expediente al Juzgado 12 Civil Municipal de Barranquilla, para que de manera inmediata le otorgue el trámite que corresponda y adopte la decisión de fondo a que haya lugar.

- PRIMERO. DEJAR SIN EFECTOS el Auto del 4 de noviembre de 2016 proferido por el Juzgado 12 Civil Municipal de Barranquilla, dentro del expediente ICC-2802.
- SEGUNDO. REMITIR al Juzgado 12 Civil Municipal de Barranquilla el expediente ICC-2802 para que, de manera inmediata, le otorgue el tramite que corresponda y adopte la decision de fondo a que haya lugar dentro de la accion de tutela formulada por el senor Jhon Janes Aguilar Gonzalez contra la Union Temporal de Servicios Integrados y Especializados de Transito y Transporte de Santa Marta.
- TERCERO. ORDENAR que, por Secretaria General, se comunique la decision adoptada en esta providencia a las partes y al Juzgado
